Terms and Conditions of Online Ticket Sales and Entry

Payment Methods
The Vic Devonport accepts Visa and Mastercard payments (online) and Cash.

Booking Fees
Tickets purchased on our website are subject to a Booking Fee per ticket which is a non-refundable charge.  The Vic Devonport reserves the right to alter any and all fees from time to time and without notice.

Allocated Seating
Where allocated seating applies to a session you have the choice of choosing your own seat at the time of ticket purchase. Otherwise seat allocation will be system generated on a “best available” basis.

Amount of Tickets per Customer or "Ticket Limits"
When purchasing tickets on our website you may be limited to a specified number of tickets for any movie session or event per transaction. 

Censor Warning
Please check the censor warning before buying tickets to shows listed on our website. Children under a certain age will not be allowed entry for a restricted movie. New Zealand’s classification law applies. See www.classificationoffice.govt.nz for details. Please also check for any additional ratings/entry restrictions that may be applicable for events/movies from time to time. 

Identification
Where tickets requiring identification are purchased, suitable identification must be presented upon collection of the tickets. Failure to present suitable identification may result in refusal of entry or upgrade payments required or tickets to alternative suitable shows offered in their place.

Order Confirmation
If you do not receive a ticket confirmation email after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm the Booking. Only you may be aware of any problem that has occurred during the purchase process. The Vic Devonport will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation. 

Ticket Collection
Your Booking confirmation will be sent via email to the email address that you entered on the Booking Confirmation page. This confirmation needs to be shown at the Cinema Ticket Counter or Booking reference entered at a Cinema Kiosk (where this is available) in order to obtain a physical ticket for entry to the movie session/event. Alternatively, you may provide the credit card used to purchase the tickets for picking up the tickets at the Cinema/Venue. 

Refunds and Exchanges
Tickets purchased via our website and over the counter are sold for a specific session only and are sold on a strict no-refund no-exchange and no-transfer basis unless required by law. Tickets to live events are non refundable. Tickets to movie sessions may be swapped to another session or a gift voucher of the same value if the swap takes place prior to the start of that movie session.

GST and Local Taxes
Prices on this website and over the counter include GST where applicable.

Pricing and Other Errors
If the amount you pay for a ticket is incorrect (regardless of whether because of an error in a price posted on this website or otherwise communicated to you), or you are able to order a ticket before its scheduled on-sale or pre-sale date or you are able to order a ticket that was not supposed to have been released for sale, then The Vic Devonport will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of human error or a transactional malfunction of this website.

Cancelled/Postponed Events
Occasionally, events are cancelled or postponed by the promoter of a show or The Vic Devonport. Should this occur, The Vic Devonport will attempt to contact you and refund the value of the ticket as per their Refunds and Exchanges policy. The Vic Devonport may, at their discretion, refuse to sell tickets to you or withdraw any tickets from sale via this website.

Force Majeure
If The Vic Devonport is prevented from delivering their service or if the customer is prevented  from attending the event due to Force Majeure (circumstances beyond their control), which shall include without limitation, a fire, flood or other extreme weather event, pandemic, natural disaster, strike, electricity, power or communications failure, shortage or unavailability of products or services or a change in applicable law The Vic Devonport is entitled to postpone or cancel the event for which the ticket was purchased. In case of a cancellation by the customer the onus of proof of the force majeure event is with the customer.

Competition Rules
By entering any promotion or competition you are bound by and agree to comply with the competition terms and conditions of that competition. 

Modification of terms
The Vic Devonport reserves the right to change these terms and conditions or modify the website from time to time. The user shall be responsible for regularly reviewing these terms and conditions.

Ticket purchase and billing information
When purchasing tickets through this website you must provide personal details, including credit card billing information. Your credit card details are used for real-time billing of ticket purchases and are not retained on our server. To facilitate your ticket purchase your billing information is shared with our banking gateway partner, Windcave. Electronic email addresses 
We will record your email address if you transmit it to us electronically. Your email address will only be used for the purpose for which you provide it and will not be added to a mailing list unless you request that this be done. We will not disclose your email address without your consent unless required to do so by law.

Governing Law
These terms and conditions shall be construed in accordance with, and shall be governed by, the laws of New Zealand.


The Vic Devonport Terms and Conditions of Entry

Entry to The Vic Devonport is based on your full agreement with these Terms and  Conditions of Entry.  No ticket refunds or exchanges will be provided upon violation of any of these conditions.

Photography & Videography
T
he Vic Devonport reserves the right to take photos or video of their own events.  Photos and video recordings may be taken in the foyer, outside The Vic or inside the cinema. If you do not wish your photo or image to be captured please notify The Vic Devonport personnel.

Anti Movie Theft Policy
Taking photos or video recordings of movies shown at The Vic Devonport is not permitted. 

Refusal of Entry
The Vic Devonport’s priority is to ensure that patrons have a safe and enjoyable experience at our venue. Management reserves the right to refuse entry to any person, and to remove from the premises, without refund, any person who violates any of these Terms and Conditions of Entry.  Behaviour deemed unacceptable by the theatre management includes but is not limited to:

  • disruptive behaviour in any way while on our premises
  • disrespectful behaviour to staff or other patrons
  • byo food or drinks without prior permission by theatre management
  • not complying with the Sale and Supply of Alcohol Act 2012
  • performing any unlawful act
  • possessing any unlawful substances

Bag Checks 
The Vic Devonport reserves the right to inspect any bag and/or articles of clothing via screening equipment and/or bag search checks. No person will be permitted entry if they have any of the following restricted items and/or they refuse to have bags checked for restricted items:

  • alcohol or drugs
  • external food or drinks
  • any kind of weapon
  • knives/sharp objects
  • video or sound recording equipment

Drugs and Alcohol 
Drugs are not permitted at The Vic Devonport. Any intoxicated person will be refused entry. The Vic Devonport is a licenced venue and only alcohol purchased at The Vic Devonport may be consumed on the premises. The Sale and Supply of Alcohol Act 2012 applies. 

Smoking & Vaping
The Vic Devonport is a non-smoking and non-vaping venue.

General Hygiene 
Staff are trained in cleaning and hygiene protocols, regularly washing hands and wearing gloves when serving food and beverages. We ask our patrons to practise good hygiene and wash hands frequently, and dispose of their rubbish at the end of sessions. Please stay away from the cinema if feeling unwell to ensure public safety.
